Mr. Folawiyo said that as a consequence, he is not a “debtor” within the meaning of Section 61 of the AMCON Act, which would justify the temporary confiscation of his assets and the freezing of his bank accounts on account of the judgment from 2017. The decision was issued in 2017.

He said that a combined reading of Sections 49(2), 50(2), and 61 of the AMCON Act would reveal that only current directors of a firm fit under the term of “debtor” as to necessitate the freezing of their assets or accounts.
